It is also important to remember that in Texas, the general rule is that you have two (2) years to settle your claim or file a lawsuit against the responsible party. But there are exceptions: 1. If the State is the potential defendant then a Notice of Claim must be given within six (6) months of the injury; 2. If a local government entity (city, etc.) is the potential defendant then a Notice of Claim must be file as soon as thirty (30) days; 3. Medical malpractice deadlines may be longer than two (2) years under certain circumstances, but it is best to act as soon as possible after the initial malpractice; and 4. Minors with injuries have special limitation issues. The clock begins ticking on the day of your injury. Statute of Limitations issues are one reason why it is so important to contact an attorney as soon as possible.

We will act on your behalf with the insurance company, medical providers and creditors to ensure that most of the worry and headaches are kept to a minimum as you recover from your accident. In some cases we can issue letters of protection to obtain medical care for you. And repaying Medicare and other health insurance entities that paid for medical care arising from your accident are complicated issues. These are more good reasons to have an attorney.

Some cases may require that suit be filed. If so, we will file suit on your behalf and pursue the case to jury trial if necessary. We are not just a “settlement” firm. We maintain a substantial litigation case load.

Once a case is in litigation the Firm utilizes the latest technology to prove a client’s case. For instance, in one recent wrongful death car/truck case, the Firm hired a helicopter and experts to photograph and survey the accident scene and create a computer reconstruction of the collision. In another case involving a DWI defendant, the Firm scanned voluminous medical records onto a CD-ROM and projected the pages onto a large screen for the jury to read along with the medical expert. An entire trial presentation can be presented on a single DVD. The Firm will also utilize mock juries and jury consultants on appropriate cases.
