It is also important to remember that in Texas, the general rule is that you have two (2) years to settle your claim or file a lawsuit against the responsible party. But there are exceptions: 1. If the State is the potential defendant then a Notice of Claim must be given within six (6) months of the injury; 2. If a local government entity (city, etc.) is the potential defendant then a Notice of Claim must be file as soon as thirty (30) days; 3. Medical malpractice deadlines may be longer than two (2) years under certain circumstances, but it is best to act as soon as possible after the initial malpractice; and 4. Minors with injuries have special limitation issues. The clock begins ticking on the day of your injury.
